Feinberg looks to create new factors for BP Claims and want`s to pay Moratorium Claims

News stories have been coming out that Feinberg is working  to develop more generous methodologies for people who make their living on other Gulf Seafood, such as shrimp, crab, and fish. Lets face it seafood from the Great Gulf of Mexico has a black eye right now, and the gulf is still environmentally challenged from the Oil Spill and then the Clean Up. The bayous and bays that are contaminated with oil and corexit, still have much of it there, right under the surface, and that is where most of the hatchlings mature. It is only fair for the GCCF under the direction of Ken Feinberg to adjust their Methodology. Currently Oystermen are given up to 7 times their 2010 losses.

Feinberg is also rethinking his stance on moratorium claims and with BP`s permission he wants to include them into the BP Claims process. This would be a blessing to many that lost most of their income due to BP`s negligence. There would never have been a moratorium if BP had not caused the biggest Oil Spill in U.S. history. The Baton Rouge Area Foundation was suppose to pay these claims, but instead denied many. If Feinberg takes charge of this, and indeed makes things right, it would be significant move of good will by Mr. Feinberg. Couple this with a possible change in methodology for people in the Gulf Seafood Industry, and we could be seeing a significant shift in Mr. Feinberg`s historical positions.

The Devastating Effects of the BP Oil Spill are still Unfolding

One year after BP’s Deepwater Horizon oil rig explosion in the Gulf of Mexico killed 11 offshore workers and triggered one of the largest environmental disasters in U.S. history, the effects are still felt and seen along the Gulf Coast.

Some scientists have deemed the health of the Gulf of Mexico as “nearly back to normal.” Perhaps some things are — tourists are slowly returning to the coast, children are back to playing in the water, food has been labeled safe for consumption. But these are just images of normality.

There is still doubt among many people near the Gulf about the safety of their water and their food. Scientists confirm that oil has been found on dead dolphins discovered along the coast, as unusual amounts of deceased marine life continue to wash ashore.

Workers are lost in the claims process, still waiting for their checks from BP. Hundreds of people in Louisiana have reported oil spill-related health problems to the state, while many others are experiencing symptoms of a mysterious illness.

And despite all of this, not only does the liability cap for Big Oil remain unchanged, but Congress has yet to pass a single major law on oil or gas drilling since the disaster.

While some may suggest that the Gulf Coast is back to normal, the devastating effects of the oil spill are still unfolding toward an uncertain future one year later. Below are some of the most iconic images from the resulting aftermath of the tragedy — visual proof that, despite being difficult and heart-breaking to take in, reminds us that we must do everything in our power to ensure an accident like this doesn’t happen again.

Key device in BP Oil Spill disaster wasn’t recertified

A critical device at the center of an investigation into the BP oil rig explosion didn’t undergo a rigorous recertification process in 2005 as required by federal regulators, a worker responsible for maintaining the equipment told investigators Wednesday.

Mark Hay of rig-owner Transocean said the blowout preventer — designed to prevent a spill in the case of an explosion — was not recertified because it was being constantly maintained. Recertifying the five-story device requires completely disassembling it out of the water and can take as long as three months to complete.

The device — which may be lifted from the seafloor a mile below the water’s surface in the coming days — failed following the rig explosion. Government scientists estimate that some 206 million gallons of oil spewed into the Gulf until mid-July, when a temporary cap stopped the flow. A permanent fix is expected to be put in place after Labor Day.

The blowout preventer will be key to the investigation into the April 20 explosion that killed 11 people and caused the biggest oil spill in U.S. history.

Testimony from BP and Transocean officials showed the device had not been recertified according to a three- to-five year timetable laid out by federal regulators; repairs were not always authorized by the manufacturer, Cameron; and in the days after the explosion confusion reined about changes to the equipment, delaying attempts to close the well.

Hay could not say how much it would have cost to recertify the blowout preventer, but said he knew it was functioning because he personally oversaw its maintenance.

The device underwent tests to ensure it was working, he told the joint investigation by the U.S. Coast Guard and the Bureau of Ocean Energy Management, Regulation and Enforcement.

The device, he said, had undergone a maintenance overhaul in February as it was being moved to the Deepwater Horizon to be placed over BP’s well.

When asked if he had any doubts April 20 that the device was in full working order, Hay said: “No, sir.”

He also detailed getting approval from Transocean’s headquarters before making modifications to the device, and in at least one case making a change requested by BP.

Harry Thierens, BP’s vice president for drilling and completions, told the federal panel documents detailing the changes to the equipment were not readily available, a waste of critical time after the explosion.

It took between 12 hours and 24 hours to get drawings of changes made to a locking system, Thierens said, and there were other changes and questions.

Economists predict that over the next five years or so, more than $4 billion in total value will be lost in homes along the Gulf Coast, can you hold the Gulf Coast Claims Facility and BP responsible? The weak job market is mostly to blame for the decline in home prices across the nation, but for homes along the 600-miles of shoreline of the Gulf, the oil spill has only made the situation worse.

Gulfport, Mississippi beachfront homes will be hit the hardest according to several reports, with an average loss of value of $56,000. Mobile, Alabama will most likely see a $45,000 decline in home value and Pensacola, Florida homes will decline in value by about $40,000.
